2 Processing of personal data

2.1 Personal data and purposes and principles of the processing

When you visit our website, use our products or services, provide products or services to us, apply with us or otherwise have contact with us, we process the personal data that are thereby collected per category of data subjects for the purposes and on the basis of the principles as described below in this chapter. We may continue to process the personal data for purposes other than those described below, but we only do this if and to the extent that the new purposes are compatible with them. In that case, we will inform you of this before your personal data are processed further.

2.1.1 Website visitors

Personal data – When you visit our website, we place essential, statistical, marketing or external media cookies and/or use similar techniques such as pixels. We use these to process the following personal data:

  • Web pages visited and hyperlinks;
  • Frequency and duration of the visit;
  • Location data and IP address.

Purposes – The purposes for which we process these personal data are to ensure the correct and optimal functioning of the websites, and to measure the use of the websites. Essential cookies ensure that the website functions properly. We use statistical cookies to measure and improve the quality and effectiveness of the website. Finally, we place marketing and external media cookies. 2.1.2 Users of the BauWatch app

Personal data – We collect data about your use of the App when you use our BauWatch App. In this context, we process the following personal data:

  • Your login status;
  • How often you log in to the App in a certain period;
  • Whether you use the livestream functionality in the App;
  • Your most visited pages in the App;
  • The device with which you use the App.

Purposes – The purposes for which we process these personal data are to ensure the correct and optimal functioning of the App. We also store and evaluate information about your (recent) visits to the App and your use of the various components of the App in order to understand how customers use them, so that we can make them more intuitive.

We will inform you about this processing when you first use the App. Within the user account in the App, you can ensure that we do not process these data via the settings.

Basis – The legal basis for the processing of these personal data is a legitimate interest, namely our interest in being able to measure the use of the website so that we can modify or improve it if necessary.

2.1.3 (Potential) customers, suppliers and service providers

Personal data – We process the following personal data of (contacts of) (potential) customers:

  • First and last name
  • (Business) email address
  • (Business) telephone number
  • Organisation

The provision of these personal data is a necessary condition for concluding an agreement. Without this information, we cannot enter into an agreement with you or the organisation you represent.

Purposes – The purposes for which we process these personal data are to offer or market our products and services, to receive products and services that are provided to us or to comply with a legal obligation.

Basis – The legal basis for the processing of these personal data is the performance of an agreement with you (or the company you represent), to take measures at your request before the conclusion of the agreement or to comply with a legal obligation that lies with us, such as the retention obligation under tax law.

Source – We collect the aforementioned personal data directly from you or your organisation. We do not use other sources to collect your personal data, unless expressly stated.

Retention period – We do not retain your personal data for longer than is necessary for the purposes described above. If the documents in which your personal data are included fall under the retention obligation under tax law, we will retain your data for seven years.

2.1.4 Visitors to trade fairs

Personal data – We process camera images of you around our stand when you visit us at the trade fair. This involves camera footage that is fully blurred immediately. Artificial intelligence allows our systems to perform some basic analyses, such as recognising whether you are wearing certain personal protective equipment visibly. In this way, our customers can obtain analytical information about the number of visitors at a particular time and/or how many of them wear such personal protective equipment.

Purposes – The purpose for which we process your personal data is to demonstrate our equipment and AI tools for the sale of these products and services.

Basis – The legal basis for processing these personal data is our legitimate interest in demonstrating our products and services to visitors at a trade fair.

Source – We collect the above-mentioned personal data via camera footage created by our cameras. We do not use other sources to collect your personal data, unless expressly stated.

Retention period – We retain the images during the fair. The data will then be deleted.

2.1.5 Job applicants

Personal data – If you apply for a job with us, we process the following data:

  • First and last name
  • Contact information
  • Interview notes, if applicable
  • Cover letter, if applicable
  • Interests, work experience and other information from the resume

The provision of these personal data is a necessary condition for assessing your application and possibly concluding an employment or other agreement with you.

Purposes – The purpose for which we process your personal data is to assess your application and to be able to contact you for a suitable position at a later date, with your consent.

Basis – The legal basis for the processing of these personal data is the performance of an agreement with you or to take measures at your request before the conclusion of the agreement or, if required, your consent.

Source – We collect the aforementioned personal data directly from you. We do not use other sources to collect your personal data, unless expressly stated.

Retention period – We will retain your application details for four weeks from the end of the application procedure. If you have given your consent, we will retain your data for one year.

2.1.6 Recipients of the newsletter

Personal data – If you receive the newsletter or have objected to receiving the newsletter, we process the following data:

  • First and last name
  • E-mail address

Purposes – The purpose for which we process these personal data is to inform you about our products and services or to prevent you from receiving our newsletter after you have opted out.

Basis – The legal basis for the processing of these personal data is our legitimate interest in informing you about our products and services or your consent, insofar as your consent is required by law. If we process your e-mail address to prevent you from receiving the newsletter after you have unsubscribed for it, we will do so within the framework of a legal obligation incumbent on us.

Purposes – The purposes for which we process personal data in the context of other means of contact are, for example, the processing of your questions, complaints or requests or in the context of winning campaigns or competitions that we organise.

Basis – The legal basis for the processing of these personal data is our legitimate interest in handling your requests and complaints and in organising prize draws or competitions.

3 Automated decision-making and profiling

We do not process your personal data to make automated decisions without human intervention or to create a profile of you based on your personal data.

4 Right to object to the processing of personal data

You have the right to object to the processing of personal data on account of your specific situation if this processing is carried out on the grounds of one of our legitimate interests. We will then stop processing your personal data, unless our interest in processing your data outweighs your interests or if our interest relates to the institution, enforcement or substantiation of a legal claim. You also have the right to object to the processing of your personal data for direct marketing purposes, such as our newsletter.

You can object to the processing of your personal data by sending an email to com in which you clearly describe your request. Please note that we must first establish your identity before we can comply with your request. The way in which we do this depends on your specific situation.

5 Other rights in relation to the processing of personal data

5.1 Right of access

You have the right to request access to the personal data we process about you, more specifically about the purposes, the categories of personal data concerned, the (categories of) recipients, the retention periods or the criteria for determining them, the source of the personal data, the existence of automated decision-making and the appropriate safeguards for the transfer of the data outside the EEA.

5.2 Right to rectification of data and restriction of processing

You have the right to have incorrect data that we process about you rectified and to have incomplete data supplemented by us. Furthermore, you have the right, at your request, to restrict the data processing in the following cases:

  • If you dispute the accuracy of the data, you have the right to request us to restrict the data processing during the period in which we verify the accuracy of the data;
  • If the processing is unlawful and you request us to limit the use of the data instead of deleting the data;
  • if we no longer need your personal data for the processing purposes, but you still need them for the institution, enforcement or substantiation of a legal claim;
  • If you have objected to the processing of your data, and you are awaiting our answer to the question as to whether our legitimate interests outweigh your interests.

5.3 Right to delete data

In the following cases, you may have the right to have personal data deleted by us at your request:

  • If we no longer need the data for the purposes for which they were collected or obtained;
  • If you have withdrawn your consent, insofar as your data are processed on the basis of consent, and we do not have any other legal ground for processing your data either;
  • If you have objected to the processing of your data and we do not have a more important interest, or if you have objected to the processing of your data for direct marketing purposes;
  • If we have to delete the personal data in order to comply with a legal obligation incumbent upon us;
  • If we have collected the personal data in connection with the provision of digital services to minors.

Please keep in mind that the above does not apply in all cases. We are not required to delete your personal data if we need them for, among other things, the institution, enforcement or substantiation of a legal claim.

5.4 Right to data transfer

If we process your personal data on the basis of your consent or in the performance of an agreement with you and the processing is automated, you have the right to obtain your data from us or to have it transferred by us to a third party in a standard file format.

5.5 Right to withdraw consent given

If your personal data are processed on the basis of consent, you have the right to withdraw the consent given. Please note that withdrawing consent does not affect the data processing that took place before you withdrew your consent.

6 Recipients of personal data

6.1 Categories of recipients

Insofar as this is necessary for the purposes described below, we share your personal data with the following (categories of) recipients:

  • Group companies, insofar as this is necessary for compliance, internal reports for audit or security purposes, or for the performance of an agreement with data subjects;
  • Government agencies, courts, supervisory authorities, law enforcement agencies or intelligence agencies, if we are obliged by law to provide personal data;
  • Our auditor, legal advisers and other professional service providers engaged by us for compliance reasons;
  • Suppliers of IT services we use;
  • Provider of services that we use to measure the effectiveness of our services and websites;
  • Third parties who wish to purchase BauWatch or one or more of its parts or are interested in buying them, including the parties involved in advising on such a transaction.

6.2 International transfers

The categories of recipients described above may be located outside the European Economic Area (EEA). If we transfer data for which we are responsible to countries outside the EEA (the so-called ‘third countries’), we will arrange for appropriate safeguards within the meaning of the GDPR. More specifically, we impose contractual obligations on recipients of personal data to adequately protect your data using the Standard Contractual Clauses (SCCs) approved by the European Commission. We will assess beforehand (with the assistance of third-country recipients where necessary) on a case-by-case basis whether the legislation and practice of the third country adversely affects the effectiveness of the SCCs. If that is the case, we will take additional measures to fill the gaps in protection and bring them to the level required by EU legislation. Upon request, we will share a copy of the SCCs we have agreed upon.
